Notice for Italian Users

Notice for users who are residents of Italy.

This notice is addressed to users who are residents of the Italian Republic and supplements Customer agreement to the extent it relates to Italian residents. In the event of any conflict, this notice takes precedence for Italian residents.

1. Cross-Border Provision of Services

I-Trade Platform services are provided by ITRADE ENTERPRISE LTD, registered in England and Wales (Company No. 09038312), registered office: 22 Kingsley Close, Birkenshaw, Bradford, West Yorkshire, United Kingdom, BD11 2NH. Services are provided on a cross-border basis from the United Kingdom in accordance with the applicable law of the jurisdictions in which the Platform operates.

This notice is for informational purposes only. It does not mean that the Company is authorised, licensed, or registered with Italian supervisory authorities (including CONSOB and Banca d'Italia), nor that it has a branch or representative office in Italy. By deciding to use the services, you acknowledge that the services are provided from outside Italy.

2. Consumer Rights

The Terms of Use are governed by the law of England and Wales. If you are a Consumer residing in Italy, the choice of governing law does not deprive you of the protection afforded by the mandatory provisions of Italian law (including the Codice del Consumo) and EU law, from which parties may not derogate by agreement.

Where provided by applicable jurisdictional rules, you may retain the right to bring proceedings before the courts of your place of habitual residence.

3. Language of the Agreement and Communications

  • The English version of the Terms of Use and related documents is the legally binding version, unless expressly stated otherwise. Versions in other languages are provided for convenience; in the event of any discrepancy, the English version prevails.
  • You may submit support requests in Italian; responses may be provided in English. Ongoing support in Italian is not guaranteed.
  • Service and legally significant notifications are sent to the email address registered to the Account and/or to the account portal.

4. Tax Obligations (autodichiarazione)

  • The Company is not a tax agent in Italy and does not withhold Italian taxes from your income. You are solely responsible for calculating, declaring, and paying applicable taxes (autodichiarazione).
  • Income and assets connected with accounts held with a foreign service provider may be subject to reporting obligations in Italy under the rules on tax monitoring of foreign assets. The applicable tax treatment depends on your personal circumstances and may change.
  • The Platform provides account statements and transaction reports that may assist in preparing your tax declaration. Such materials do not constitute tax advice. We recommend consulting a qualified tax adviser (commercialista).

5. Crypto-Assets

For EEA clients, Regulation (EU) 2023/1114 (MiCA (Regulation (EU) 2023/1114)) applies to crypto-asset services to the extent it covers the relevant services and assets. Crypto-assets are not covered by deposit guarantee schemes or investor compensation schemes (including Italian schemes or the UK FSCS). The value of crypto-assets may fluctuate significantly; you may lose all of the amount invested.

6. Leveraged Products and Risk Warning

  • Trading leveraged products involves a high level of risk. A significant proportion of retail client accounts lose money when trading such products. Ensure that you understand the risks and can afford to take them.
  • Access to certain products may be restricted or subject to an appropriateness assessment, taking into account product intervention measures applicable in the EU and Italy. Where applicable requirements change, access to products may be adjusted with notice to Clients.
  • Detailed information about risks is set out on the "Disclosures".

7. Complaints and Out-of-Court Settlement

  • Complaints should be directed to [email protected] (for legal enquiries — [email protected]); your complaint may be submitted in Italian. We will acknowledge receipt of the complaint and endeavour to provide a substantive response within 15 Business Days; in complex cases we will notify you separately of any extension.
  • If you disagree with the response, you may make use of applicable alternative dispute resolution (ADR) mechanisms available to consumers in Italy and the EU, to the extent applicable to your situation. For disputes arising from contracts concluded online, consumers in the EU may also use the European Online Dispute Resolution (ODR) platform, where available.
  • The right to bring proceedings before a court is preserved in all circumstances.
